These Terms and Conditions apply to the UNDER RETAIL CAMPAIGN (the “Campaign”) organized by WRISTCHECK EXCHANGE LIMITED (“Wristcheck”). 

By participating in the Campaign, you (“Participant”) agree to these Terms and Conditions. The Wristcheck Privacy Policy, Wristcheck Warranty, Wristcheck Terms & Conditions, Buyer Terms and Conditions and Seller Terms and Conditions shall continue to apply as applicable. If there is any inconsistency between these Terms and Conditions and any other terms, these Terms and Conditions shall prevail.

The Campaign 

1. The Campaign runs from 10 January 2025, 12:00 AM Pacific Standard Time to 31 January 2025, 12:00 AM, Pacific Standard Time (the “Campaign Period”).  

2. In this Campaign, Wristcheck offers special discounted prices for selected products (“Campaign Products”) on Wristcheck’s website. 

3. To participate, Buyer User must have registered a Wristcheck account and make a purchase on the Campaign Product during the Campaign Period. Discounts and offers are automatically applied at checkout.

4. All offers and discounts are subject to availability and may be changed or withdrawn without notice.

5. Discounts cannot be combined with any other offers or promotions unless explicitly stated.

6. The Buyer User shall pay the full payment of the discounted price of the Product as indicated in the Campaign Products pursuant to the instructions of Wristcheck. Should the Buyer User fail to make the required payment within the specified timeframe, the transaction will be canceled, and the Product may be immediately available for sale without any further notice. The Buyer User hereby acknowledges and agrees that unless otherwise specified by Wristcheck, any payment made from the Buyer User shall not be refundable.

7. Wristcheck will not provide Bidding services (Negotiate) for the Campaign Products.

8. ‘'Requesting for Products” is not available for Campaign Products. Campaign Products are subject to quota, while stock lasts.

9. Wristcheck offers the option to include a personal message with your order. Please ensure your message does not contain objectionable language or inappropriate content. Wristcheck reserves the right to remove any such content at its discretion.

10. Special terms and conditions applied to Campaign Products. Buyer Users should read through these Terms and Conditions before participating in the Campaign.

Delivery, Refund & Exchange

11. Unless otherwise specified in these Terms and Conditions, Products purchased from Wristcheck's website during the Campaign Period are subject to our Buyer Terms and Conditions. If there is any inconsistency between the Buyer Terms and Conditions and these Terms and Conditions, these Terms and Conditions shall prevail. 

12. Any return, exchange or refund requests will not be entertained for Brand New Watches once the payment has been made. The Buyer Return Period does not apply to Brand New Watches. “Brand New Product” is labeled on the Product Page.

13. The dispatch time frame for the Campaign Products may take longer than 3 business days. Brand New Products may take even longer.

14. If Buyer User opts for product delivery, Buyer Users may check the delivery timeline via the provided tracking link from the courier and shall contact the courier for queries. Once the order is dispatched, Wristcheck has no control over the delivery schedule. 

Disclaimers

15. Wristcheck has the absolute right, without any compensation and prior notice, to:

1. suspend or terminate the Campaign for whatsoever reasons;
2. change and modify these Terms and Conditions (including but not limited to extending the Campaign Period) at any time; and/or
3. disqualify any participants for whatsoever reasons Wristcheck deems fit (including but not limited to any participants who are in breach of these Terms and Conditions, provided any invalid or incorrect information during the process of registration of the Wristcheck Account, and/or committed any illegal, dishonest, or improper acts in participation of the Campaign).   

16. To the extent permitted by laws, Wristcheck, its affiliates, sponsors, agents and their respective directors, officers, employees, agents and assignors shall not be liable and/or responsible to any participant for the following events. You agree to release, discharge and hold harmless the aforementioned parties for:

1. your failure to redeem any discounts and offers as a result of any network, communication, or system error, interruption and/or failure;
2. your failure to purchase any products via a valid bank account or credit card  to enjoy any discounts and offers;
3. any losses, damages, costs, expenses and/or claims suffered by you arising out of or in connection with the Campaign; and/or
4. any other matters outside Wristcheck’s reasonable control.

General Provisions

17. Capitalized terms used herein without definition shall have the meanings given to them in the Wristcheck Terms & Conditions.

18. Unless the context otherwise requires words denoting the singular shall include the plural and vice versa and words denoting any one gender shall include all genders. 

19. The headings of these Terms and Conditions are for ease of reference and shall not affect the constructions or interpretation of these Terms and Conditions.

20. If any of the provisions in these Terms and Conditions are deemed invalid, illegal, or for any reason becomes unenforceable, that provision will be ineffective and deemed severable and will not affect the validity and enforceability of the remaining provisions of these Terms and Conditions.

21. Any person other than the parties to these Terms and Conditions shall have no rights under these Terms and Conditions and shall not enforce these Terms and Conditions under the Contracts (Rights of Third Parties) Ordinance (Cap. 623). 

22. These Terms and Conditions are governed by and shall be construed in all respects in accordance with the laws of the Hong Kong Special Administrative Region all the parties hereto hereby submit to the exclusive jurisdiction of the Hong Kong courts in connection with any matters arising hereunder. 

23. If there is any dispute over the Campaign or these Terms and Conditions, Wristcheck shall make the final decision and such decision shall be binding.
