Buyer Terms and Conditions

These Buyer Terms and Conditions (“Buyer Terms and Conditions”) form a legally binding agreement between the Buyer User (as defined under the Wristcheck Terms and Conditions) and Wristcheck (each a “Party”, collectively the “Parties”). Please read below the Buyer Terms and Conditions (“Buyer Terms and Conditions”) applicable to Buyer Users along with the Wristcheck Terms and Conditions. By purchasing any Products and/or professional services through Wristcheck, the Buyer User agrees to be bound by these Buyer Terms and Conditions and the General Terms and Conditions. If there is any inconsistency between these Buyer Terms and Conditions and the Wristcheck Terms and Conditions, the Buyer Terms and Conditions shall prevail. If there is any inconsistency between the service terms and conditions and Buyer Terms and Conditions, the service terms and conditions shall prevail. If any dispute arises about the interpretation of these Buyer Terms and Conditions, Wristcheck’s decisions and interpretations will be final. 1. Purchasing Products

All Products shown on Platform are subject to availability and an order confirmation. Buyer Users will be notified if the Products are unavailable. Some Products may not be available for dispatch until work (including but not limited to watch authentication) has been completed. Wristcheck will let Buyer Users know within 3 working days of purchase if this applies to the order. Wristcheck will endeavor to complete work quickly and let Buyer Users know the latest timelines. 

The Buyer User shall make the required deposit to Wristcheck’s designated bank account or other agreed payment method within 24 hours of Wristcheck issuing the invoice and settle the remaining balance within 3 business days of the said invoice. 

Should the Buyer User fail to make any payment within the specified timeframe, the deal will be canceled, and the Product will be available for sale again immediately without any further notice.

The Buyer User further agrees and acknowledges that if the Buyer User fails to pay the remaining balance within 4 business days of invoice, the deposit will be forfeited absolutely and no refund will be issued to the Buyer User. However, Wristcheck may at its discretion (but without any obligations to) offer store credits of an amount equivalent to or less than the amount of forfeited deposit to the Buyer User, subject to the terms and conditions provided by Wristcheck.

2. Requesting for Products

The Buyer User may make a Request for Products which are not currently available on the Platform. Once the availability of the requested Product and the selling price are confirmed by Wristcheck and the Buyer User, the Buyer User shall be bound by the applicable terms and conditions in relation to making a Purchase and/or Offer unless otherwise specified.

The Buyer shall pay the deposit and/or the full payment of the requested Product pursuant to the instructions of Wristcheck. Should the Buyer User fail to make the required payment within the specified timeframe, the deal will be canceled, and the requested Product may be immediately available for sale without any further notice. The Buyer hereby acknowledges and agrees that unless otherwise specified by Wristcheck, (i) any payment made under Request upon confirmation from the Buyer shall not be refundable.

Notwithstanding anything contained herein to the contrary, in the event Wristcheck is unable to confirm a Request with a Seller User within the timeframe agreed with a Buyer User (through no fault of the Buyer User) and a deposit payment has already been made by the Buyer User, the Buyer User will have the option to either (i) receive a full refund of the deposit (without interest) made pursuant to the relevant Request; or (ii) extend the timeframe for the Request in writing for an additional 72 hours.

3. Shipping of purchased products and products for professional services

3.1 Shipping Charges

1. All prices displayed on the Platform for the Products are exclusive of Taxes and shipping charges (unless otherwise specified). Upon checkout, Buyer Users will see the applicable shipping charges (unless otherwise waived by Wristcheck to purchase the Products. When in doubt, Buyer Users can contact the Customer Care team of Wristcheck.
2. Taxes and duties are applicable to the order of Buyer Users depending on the shipping country of the order. Buyer Users will be solely responsible for the payment of import tax and duties (if any) levied by the country to which the products are shipped and payment of such import tax and duties is a prerequisite for the release of the products ordered from the Customs on arrival to the relevant countries. Orders to be shipped within Hong Kong SAR are not subject to Taxes and duties. Buyer Users placing orders from countries served on a Delivery Duty Unpaid (DDU) basis will be charged for the price of the products (excluding taxes and duties) and the shipping charges. The carrier will contact Buyer Users about details of any import charges due (if any). Buyer Users are advised to contact their local customs authority if they want to determine the cost of import tax and duties of the order prior to placing an order with Wristcheck.

3.2 Shipping Arrangement

1. Wristcheck will arrange for Products to be dispatched after it has confirmed the Purchase and/or Offer of Buyer Users. The order is only confirmed when Wristcheck sends Buyer Users a confirmation email confirming the Request, the acceptance of Purchase or Offer (as applicable) and related payment in accordance with the Terms and Conditions. Unless Buyer Users proceed with Self-Arranged Shipping (as defined below), Buyer Users will be given an estimated delivery time (and tracking code details) in the confirmation email.
2. Prior to purchasing on Platform, Buyer Users shall ensure all shipping and contact details (including but not limited to delivery address, postcode, contact name, company name, contact number, email address, as applicable) and carriers’ name and address (as applicable) provided to Wristcheck are correct and accurate for delivery arrangements. Unless Buyer Users proceed with Self-Arranged Shipping (as defined below), Wristcheck will arrange shipping of products with credible and reliable carriers (including but not limited to FedEx, Malca-Amit, Ferrari, UPS and/or DHL) and shall ensure all products are professionally wrapped for shipping. Wristcheck is not responsible for any loss or damages incurred during transit.
3. Wristcheck may (but shall have no obligation to) purchase an insurance policy to cover shipping of products shipped by Wristcheck. Typically the products will be insured with a coverage of up to the relevant product’s final purchase price. For the avoidance of doubt, re-route of a product, return or otherwise sending of product to Wristcheck arranged by Buyer Users or other party (that is not Wristcheck) will not be covered by the said insurance policy (even if the relevant product is covered by Wristcheck Warranty and/or original manufacturer warranty). Buyer Users agrees and acknowledge that such insurance may not cover certain circumstances, including but not limited to : (I) seizure of goods, including seizures by custom authorities; (II) war risks for domestic U.S. shipments; (III) radioactive contamination; (IV) delay; (V) inherent vice; (VI) loss of, damage to or breach of data or other non-tangible content; (VII) fraud by Buyer User, the shipper or consignee; (VIII) cyber attacks; (IX) illicit trade; (X) concealed damages and losses (within sealed packages delivered intact); (XI) mechanical/ electronic derangement to used or unsealed new merchandise; (XII) damages attributable to insufficient packing; (XIII) breakage to fragile and delicate items such as those used for clocks or glassware; (XIV) false/erroneous information provided by Buyer User, the shipper or consignee; package labels being changed or revised in the course of transportation for the purpose of fraudulent redirection; ( X ) shipments being sent as a result of fraud or trick upon the Buyer User, shipper and/or consignee (including but not limited to product orders made by imposters); (XVI) abandonment by Buyer User, the shipper or the consignee; and (XVII) all risks of a shipment being re-routed, stopped in transit or retrieved at a point other than the original consigned delivery point pursuant to any instruction or representation to the designated approved carrier by a fraudster or imposter. Any insurance will not also cover Self-Arranged Shipping (as defined below). The Buyer User is recommended to purchase an insurance policy to cover shipping of products which are regarded as Self-Arranged Shipping (as defined below) and such insurance shall cover any losses and damages to the product and its accessories (including but not limited to watch box, paper, extra straps) and outer packaging.
4. Buyer User may contact Watch Specialists for self-arranged shipping, which involves Buyer User selecting their own credible and reliable carriers, preparing sufficient and accurate shipping documents (including but not limited to shipping label, commercial invoice), making custom declarations and settle payment with the carrier by Buyer User themselves; and Wristcheck packing and delivering the product to Buyer User’s designated carrier (“Self-Arranged Shipping”). Wristcheck shall have the absolute discretion to reject any request for Self-Arranged Shipping without providing a reason. Buyer Users who proceed with Self-Arranged Shipping shall bear all associated costs and expenses and assume all risks related to the shipment. To opt for Self-Arranged Shipping, Buyer Users acknowledge and agree that they will lose the right to return products and Wristcheck shall not be liable for any loss and damage arising out of or in connection with Self-Arranged Shipping. Wristcheck shall not be liable for any loss or damage incurred during transit from Wristcheck to Buyer User’s designated carrier, nor for any loss or damage incurred after the product is handed over to the carrier.
5. Wristcheck will truthfully report and declare the required information, including but not limited to the invoice value and purpose of the products, as requested by the carriers. Wristcheck will not entertain any requests to declare a lesser value or provide false information.
6. Wristcheck will not be liable for any delay in delivery of products that is caused by a Force Majeure Event or the failure of Buyer Users to provide Wristcheck with adequate delivery instructions.
7. A signature is required for receipt of the products by an adult (aged 18 years or over, or the legal age as applicable to Buyer Users countries’ jurisdiction) upon receiving the parcel (whether Buyer Users or a member of the household of Buyer Users). If Buyer Users cannot be contacted, or were not there to receive or pick up the order, it shall be Buyer Users’ responsibility to contact their local courier to arrange for a re-delivery or pickup, and Buyer Users shall indemnify Wristcheck against all costs and damages incurred by Wristcheck in relation thereto (including a reasonable daily storage fee or any other reasonable third-party charges incurred in respect thereof). If the carrier fails to deliver the order (after an acceptable number of failed attempts, at the discretion of said carrier), Buyer Users will be responsible for all costs related to re-delivery, storage or any other costs incurred by the carrier. Upon a failed delivery attempt, the carrier may leave a note or calling card for Buyer Users to re-arrange delivery, if no-one is available upon delivery attempt. Alternatively, Buyer Users may need to pick up the products from the local delivery office or service stations with adequate proof of identity.
8. Wristcheck may arrange separate packages and shipping for products and/or arrange separate packages and shipping for any accessories of a purchased Product that incorporate certain materials (including but not limited to exotic skin, mother of pearl and precious stones) at its absolute discretion. Wristcheck does not guarantee successful delivery of such materials to Buyer Users countries’ jurisdiction, and Wristcheck will not be liable (and Wristcheck’s insurance policy will not cover) if such materials cannot be delivered due to unexpected circumstances (for example, but without limitations, customs hold, theft and loss).
9. Buyer Users acknowledge and agree that it is Buyer User’s sole responsibility to assess and comply with all applicable customs declarations and/or pay additional fees to the customs authority for any purchased Product(s) and/or the materials incorporated in the purchased Product(s). Wristcheck shall not be liable for any customs declarations and/ or payments related to Buyer User's purchase(s), including but not limited to import duties, taxes, or any other fees imposed by the customs authority.
10. Wristcheck currently only offers shipments to the following countries or regions (list of which may be amended by Wristcheck from time to time without advance notice): 
    Anguilla, Antigua, Aruba, Australia, Austria, Bahamas, Bahrain, Barbuda, Belgium, Bermuda, Bonaire, British Virgin Island, Brunei, Canada, Cayman Islands, Chile, Cyprus, Denmark, Faeroe Islands, Finland, France, French Polynesia, Germany, Gibraltar, Greece, Grenada, Guam, Hong Kong, Hungary, Ireland, Italy, Jamaica, Japan, South Korea, Liechtenstein, Luxembourg, Macau, Malaysia, Mauritius, Monaco, Montserrat, Netherlands (Holland), New Zealand, Norway, Panama, Philippines, Poland, Portugal, Puerto Rico, Qatar, Saudi Arabia, Seychelles, Singapore, Spain, Sri Lanka, St. Barthelemy, St. Kitts And Nevis, St. Lucia, St. Vincent, Sweden, Switzerland, Taiwan, Thailand, Trinidad And Tobago, U.S Virgin Islands, United Arab Emirates, United Kingdom, United States (48 contiguous states), Vietnam.
    Exclusions may apply to transactions over US$100,000.
     
11. Wristcheck currently does not ship to the following countries or regions (list of which may be amended by Wristcheck from time to time without advance notice):

4. In-Store Pickup of purchased products and products for professional services

Buyer Users may choose to pick up products at Wristcheck’s boutique in The Landmark, Central, Hong Kong. Buyer Users will need to present the confirmation email and a valid identification document when picking up the order.
Buyer Users have the right to appoint an authorized person to pick up the order on their behalf, and must present the purchase confirmation email along with adequate proof of valid identity and a duly signed written authorization form (to be requested from Wristcheck at least 24 hours in advance of pickup time by emailing Wristcheck Customer Care team at concierge@wristcheck.com and signed by Buyer Users and the authorized person).

Buyer Users must (or must authorize a person to) pick up the order within 7 calendar days from the date Wristcheck notifies the Buyer Users of the successful purchase of a Product or completion of professional service of a product. If a product is not picked up within the said timeframe:

(i) any request for return will not be entertained; and

(ii) the Buyer User will be deemed to engage Wristcheck for a storage service of the product, subject to a charge of USD 100.00 per month. Wristcheck shall not be liable for the performance of such storage duties except for fraud or wilful misconduct. The Buyer User agrees that the Buyer User shall pay the full monthly storage fee to Wristcheck even if the storage period is less than a month. The Buyer User hereby agrees that Wristcheck shall have a lien over the product, the product will not be available for pick-up unless and until the Buyer User has settled the storage fee. If the Buyer User fails to (or fails to authorize a person to) pick up the product within [24] calendar months from the date the product becomes available for pickup, Wristcheck may exercise its right (but shall have no obligation to) to sell product (including but not limited to selling in the open market or by way of tender) on the Buyer User’s behalf at any price. The proceeds of which shall be refunded to the Buyer User without interest, subject to the deduction of any sums due to Wristcheck by the Buyer User and the reasonable costs incurred by Wristcheck in relation to the sale.

5. Inspection of purchased products and products for professional services

1. When purchasing on Platform and opting for delivery, the Buyer User shall inspect the Product without opening the security seal, otherwise, the Buyer will lose the right to return automatically.
2. For both shipping and in-store pickup method, Buyer Users will need to sign a confirmation of receipt of the order upon receipt or of pickup of the products (as applicable). By signing it, Buyer Users
   1. accept the responsibility for the products thereon (Wristcheck will not be held accountable for any damages subsequently identified) and the risk of the products shall be passed to the Buyer Users; and 
   2. agree the 7 days buyer-return period after receipt (if any) for the order will commence forthwith.
3. When purchasing and/or opting for in-store pickup - Upon purchase Buyer Users accept the responsibility of the products and agree to our ‘No Return’ policy.
4. Buyer Users agrees that once the confirmation of receipt of the order is signed upon receipt or of pickup of the products, it constitutes evidence of delivery and fulfillment of the order by Wristcheck.

6. Return of purchased Products

1. Where the order has the Seven-[7]-day buyer-return period (7-days counted from the date which the confirmation of receipt is signed by the recipient), Buyer Users may return the relevant Product that has been received or picked up by Buyer Users to Wristcheck prior to the expiration of such buyer-return period, provided that the Product is in its original packaging and the security seal is intact. However, the final decision whether to accept a return and/or to provide any or full refund of payment made will be at the sole discretion of Wristcheck. Illustration of an example of where Wristcheck may accept return of Products is where, in the reasonable view of Wristcheck, the Product does not correspond to the descriptions on the Platform. For the avoidance of doubt, Wristcheck will not accept a return of Product where Buyer Users (or the recipient of the Product) have a change of mind to not purchase the Product.
2. If the seven-[7]-days buyer-return period does not apply, which includes but is not limited to in-store purchases, in-store pickups, Self-Arranged Shipping products, and products specified by Wristcheck, Buyer Users will not be eligible for returns.
3. Buyer Users may send Products which are not returnable to Wristcheck for repair subject to the terms of the Wristcheck Warranty. 
4. Any Products to be returned or sent to Wristcheck (whether under the buyer-return period or Wristcheck Warranty) are to be arranged through Self-Arranged Shipping at Buyer User’s own costs and risks. Wristcheck is not responsible for (and Wristcheck's insurance policy will not cover) any loss or damages incurred during transit.
5. Buyer Users acknowledge and agree that it is Buyer User’s sole responsibility to assess and comply with all applicable customs declarations and/or pay additional fees to the customs authority for any returned Product(s) and/or the materials incorporated in the returned Product(s). Wristcheck shall not be liable for any customs declarations and/or payments related to Buyer User's return(s), including but not limited to import duties, taxes, or any other fees imposed by the customs authority.
6. Returns will only be valid if the Products are in the same condition that they went out in. If Wristcheck does not believe that this clause has been met, Wristcheck withholds the right to refuse returns. Returned Products will be inspected by Wristcheck’s Professional Services team. Buyer Users will incur a charge for any work necessary if the returned Products are found to be damaged or otherwise compromised from Buyer Users handling the Products beyond what is necessary to establish the nature, characteristics and functioning of the Products.
7. Buyer Users acknowledge that any paperwork (including but not limited to warranty cards, certificates, where supplied) substantially increases the value of the Products and that its absence or damage will affect the value of the Products. If Buyer Users return the Products with missing or damaged Paperwork, Wristcheck will not accept the return, and the Product will be shipped back to the Buyer User at the Buyer Users' own cost.
8. Buyer Users must inform Wristcheck prior to exercising their right to return, either through the Watch Specialist that assisted with their order or email Wristcheck Customer Care team at concierge@wristcheck.com and advise Wristcheck the purpose of the shipment (such as return, repair under Wristcheck warranty, professional services) and to confirm the Wristcheck delivery contact details.
9. Return postage, packaging and insurance will be the responsibility of Buyer Users, and Buyer Users must follow the reasonable instructions of Wristcheck. It is recommended to use a tracked mail system and retain proof of postage. Insurance must cover the full value of the Products. Buyer Users must ensure the Products are packaged appropriately to prevent damage during transit.
10. Below are some suggestions on how to pack and send the Products to Wristcheck. If Buyer Users are based in Hong Kong, Buyer Users are encouraged to drop off their Products at Wristcheck boutique in The Landmark, Central, Hong Kong for security reasons.
    Disclaimer: Please note that these are only suggestions and Wristcheck is not responsible for any damages even after following the steps listed.
    • Avoid using branded packaging. A plain and sturdy cardboard box works best.
    • Wrap up the Product and all accessories safely and securely with bubble wrap to avoid scratches and damage during transit.
    • Along with the Product, please remember to pack by bubble wrapping all of the Product’s accessories in the cardboard box – its original box, papers and any other parts that it came with upon purchase. 
    • If the Product’s strap or any of its accessories contain exotic skins, they should be shipped in a separate package.
    • Pack the bubble-wrapped items in a sturdy cardboard box and seal it carefully with packing tape.
    • Arrange pick-up or drop-off services from a trusted courier (such as DHL, FedEx, UPS, Malca-Amit or Ferrari Logistics) with a shipment tracking system. 
    • Be sure to inform concierge@wristcheck.com with the tracking number, Buyer Users name and any other details that pertain to the Product once the shipment has been picked up by the courier.

7. Payment Terms and Default in Payment

All bank charges in connection with the payment made to Wristcheck shall be solely borne by the Buyer User. The Buyer User shall include the invoice number in the wire transfer and provide his/her Wristcheck watch specialist with the remittance proof.

Without prejudice to the right of the Wristcheck to exercise any of its other rights or remedy, in the event of default in payment by the Buyer User, the Buyer User shall further pay to Wristcheck on demand interest on the amount in arrears at the rate of 3% per month (prorated) calculated from the date on which the same became due for payment until the date of payment.

In the unlikely event that a payment error occurs where the Buyer User has been charged an incorrect amount, Wristcheck shall refund the excess amount (without interest) to the Buyer User as soon as possible upon the written request of the Buyer User and the Buyer User shall pay the outstanding amount as soon as possible upon the written request of Wristcheck. If the Buyer fails to pay the outstanding amount within the specified period, Wristcheck shall have the right to cancel the order without incurring any liability to the Buyer User.

8. Miscellaneous

1. Nothing contained or implied herein shall constitute or be deemed to constitute a partnership or joint venture between the Parties.
2. Except with the prior written consent of the other Party, either Party shall not be entitled to assign or transfer the benefit or burden of any provision herein. A person who is not a Party shall have no rights under the Contracts (Rights of Third Parties) Ordinance (Cap 623 of the laws of Hong Kong, as amended from time to time) to enforce any term contained herein.
3. These Buyer Terms and Conditions may be updated by Wristcheck from time to time. Wristcheck will inform the Buyer User of any updates by email. The changes to these Buyer Terms and Conditions shall apply on the date specified in the said email. If the Buyer User does not accept the revised version, the Buyer User shall refrain from making any purchase through Wristcheck.
4. Any notice, demand or other communication so addressed to the Buyer User shall be deemed to have been delivered when sent (with confirmation that the same has been transmitted to the Buyer User’s registered email address with Wristcheck) and any notice, demand or other communication so addressed to Wristcheck shall be deemed to have been delivered when sent (with confirmation that the same has been transmitted to concierge@wristcheck.com). The Buyer User shall inform Wristcheck as soon as possible on the change of his/her registered email address.
5. If any provision in these Buyer Terms and Conditions is for any reason held invalid or unenforceable in any respect, such invalidity or unenforceability shall not affect any other provision of these Buyer Terms and Conditions, but, rather, such invalid or unenforceable provision shall be enforced to the fullest extent permitted by law.
6. These Buyer Terms and Conditions shall be governed by the laws of Hong Kong. The Buyer User and Wristcheck hereby agree to submit to the non-exclusive jurisdiction of the courts of Hong Kong.
