United States Wristcheck Buyer Terms and Conditions

These Buyer Terms and Conditions (“Buyer Terms and Conditions”) form a legally binding agreement between the Buyer User (as defined under the Wristcheck Terms and Conditions (the “Terms and Conditions”)) and Wristcheck (each, a “Party”, and, collectively, the “Parties ”). By purchasing any Products through Wristcheck, the Buyer User agrees to be bound by these Buyer Terms and Conditions and the Wristcheck Terms and Conditions. If there is any inconsistency between these Buyer Terms and Conditions and the Wristcheck Terms and Conditions, the Buyer Terms and Conditions shall prevail. If any dispute arises about the interpretation of these Buyer Terms and Conditions, Wristcheck’s decisions and interpretations will be final. Should Buyer Users have any questions relating to these Buyer Terms and Conditions, please contact the Wristcheck Customer Care team at concierge@wristcheck.com. Terms used but not defined in these Buyer Terms and Conditions have the meanings set forth in the Terms and Conditions.
All Products shown on the Platform are subject to availability and an order confirmation from Wristcheck. Buyer Users will be notified if any Products are unavailable. Some Products may not be available for dispatch until certain work (including, but not limited to, watch authentication) has been completed. Wristcheck will let Buyer Users know within 3 working days of purchase if such additional work applies to the order. Wristcheck will provide Buyer Users with updates as to the expected timelines.
In the unlikely event that a payment error occurs where the Buyer User has been charged an incorrect amount, (i) if such charge exceeds the intended amount, Wristcheck shall refund the excess amount to the Buyer User as soon as possible upon the written request of the Buyer User; and (ii) if such charge is less than the intended amount, the Buyer User shall pay the outstanding amount promptly upon the written request of Wristcheck. If the Buyer User fails to pay the outstanding amount within the specified period, Wristcheck shall have the right to cancel the order without incurring any liability to the Buyer User.
2.1. Shipping Charges
- All prices displayed on the Platform for the Products are exclusive of Taxes and shipping charges (unless otherwise specified). Upon checkout, Buyer Users will see the applicable shipping charges (unless otherwise explicitly waived in writing by Wristcheck). When in doubt, Buyer Users can contact Wristcheck’s Customer Care team at concierge@wristcheck.com.
- Taxes and duties are applicable to the order of Buyer Users depending on the shipping country of the order. If you are based in the U.S., Buyer Users placing orders from countries served on a Delivery Duty Paid (DDP) basis, the checkout price includes the product cost, shipping charges, and applicable import taxes and duties. Buyer Users are advised to contact their local customs authority if they want to determine the cost of import tax and duties of the order prior to placing an order with Wristcheck. Buyer Users shall be responsible for and/or indemnify Wristcheck against all costs and damages incurred by Wristcheck (including a reasonable daily storage fee or any other reasonable third-party charges incurred in respect thereof) in connection with an order that fails to be dispatched due to the Buyer Users' failure to cover their own Taxes and/or duties.
2.2. Shipping Arrangements
- Wristcheck will arrange for Products to be dispatched after it has confirmed the Purchase and/or Offer of Buyer Users. Such confirmation shall not be effective until Wristcheck sends the Buyer User a confirmation email confirming the Request, the acceptance of the Purchase or Offer (as applicable) and related payment in accordance with the Terms and Conditions. The Buyer User will be given an estimated delivery time (and tracking code details) in the confirmation email.
- Prior to purchasing on the Platform, Buyer Users shall ensure all shipping and contact details (including, but not limited to, delivery address, postcode, contact name, company name, contact number, and email address, as applicable) provided to Wristcheck are correct and accurate for delivery arrangements.
- Wristcheck may (but shall have no obligation to) purchase an insurance policy to cover shipping of Products shipped by Wristcheck. Typically, a Product would be insured with coverage up to the value of the relevant Product’s final purchase price. For the avoidance of doubt, any return or other transmission of Product to Wristcheck arranged by Buyer Users or another party (that is not Wristcheck) will not be covered by said insurance policy (even if the relevant Product is covered by Wristcheck Warranty and/or a warranty from the original manufacturer).
- Wristcheck will arrange shipping of its Products with credible and reliable carriers (including, but not limited to, FedEx, Malca-Amit, Ferrari, UPS and/or DHL) and shall ensure all Products are professionally wrapped for shipping. Wristcheck is not responsible for any loss or damages incurred during transit.
- Wristcheck will truthfully report and declare the required information, including, but not limited to, the invoice value and purpose of the Products, to the extent such information is requested by the relevant carrier(s) or respective brokers.[Wristcheck will not entertain any requests to declare a lesser value or provide false information.]
- Wristcheck will not be liable for any delay in delivery of the Products (when applicable) that is caused by a Force Majeure Event or the failure of Buyer Users to provide Wristcheck with adequate delivery instructions.
- A signature may be required for receipt of the Products by an adult (aged 18 years or over, or the legal age pursuant to the laws of the Buyer User’s country or jurisdiction) upon receiving the parcel (whether the Buyer User or a member of the household of the Buyer User). If the Buyer User cannot be contacted, or was not there to receive the order directly, it shall be the Buyer User’s responsibility to contact their local courier to arrange for a re-delivery or pickup, and the Buyer User shall indemnify Wristcheck against all costs and damages incurred by Wristcheck in relation thereto (including a reasonable daily storage fee or any other reasonable third-party charges incurred in respect thereof). If the carrier fails to deliver the order after an acceptable number of failed attempts, at the discretion of said carrier, the Buyer User will be responsible for all costs related to re-delivery, storage or any other costs incurred by the carrier. If no one is available to receive a delivery attempt (i.e., a failed delivery attempt), the carrier may, in its sole discretion, leave a note or calling card for the Buyer User to re-arrange delivery. Alternatively, the Buyer User may need to pick up the Products from the carrier’s local delivery office or service stations with, at the discretion of the carrier, adequate proof of identity.
- Wristcheck may arrange for separate packages and shipping for purchased Products and/or separate packages and shipping for any accessories of a purchased Product that incorporate certain materials (including, but not limited to, exotic skin, mother of pearl and precious stones) at its absolute discretion. Wristcheck does not guarantee successful delivery of such materials to the Buyer User’s country or jurisdiction, and Wristcheck will not be liable (and Wristcheck’s insurance policy will not cover) if such materials cannot be delivered due to unexpected circumstances (for example, but without limitations, customs hold, theft and loss).
- Buyer Users acknowledge and agree that it is each Buyer User’s sole responsibility to assess and comply with all applicable customs declarations and/or pay any additional taxes, duties, tariffs and other fees to the customs authority for any purchased Product(s) and/or the materials incorporated in the purchased Product(s). Wristcheck shall not be liable for any customs declarations and/ or payments related to Buyer User’s purchase(s), including, but not limited to, import duties, tariffs, taxes, or any other fees imposed by the customs authority.
- Wristcheck currently only offers shipments of Products to the following countries or regions (list of which may be amended by Wristcheck from time to time without advance notice):
- Anguilla, Antigua, Aruba, Australia, Austria, Bahamas, Bahrain, Barbuda, Belgium, Bermuda, Bonaire, British Virgin Island, Brunei, Canada, Cayman Islands, Chile, Cyprus, Denmark, Faeroe Islands, Finland, France, French Polynesia, Germany, Gibraltar, Greece, Grenada, Guam, Hong Kong, Hungary, Ireland, Italy, Jamaica, Japan, South Korea, Liechtenstein, Luxembourg, Macau, Malaysia, Mauritius, Monaco, Montserrat, Netherlands (Holland), New Zealand, Norway, Panama, Philippines, Poland, Portugal, Puerto Rico, Qatar, Saudi Arabia, Seychelles, Singapore, Spain, Sri Lanka, St. Barthelemy, St. Kitts And Nevis, St. Lucia, St. Vincent, Sweden, Switzerland, Taiwan, Thailand, Trinidad And Tobago, U.S Virgin Islands, United Arab Emirates, United Kingdom, United States (48 contiguous states), Vietnam.
- Exclusions may apply to transactions over US$100,000.
- Wristcheck currently does not ship to the following countries or regions (list of which may be amended by Wristcheck from time to time without advance notice):

[During the check-out process on the Platform, Buyer Users may choose to pick up the Products at Wristcheck’s boutique in The Landmark, Central, Hong Kong.] Buyer Users must present the confirmation email and valid proof of identification (including identity card or passport) when picking up the order.
Buyer Users may appoint an authorized person (“Authorized Person”) to pick up the order on their behalf, and such Authorized Person must present the purchase confirmation email along with valid proof of identification and a written authorization form (to be requested from Wristcheck at least 24 hours in advance of the designated pickup time by emailing Wristcheck Customer Care team at concierge@wristcheck.com) duly signed by the Buyer User and the Authorized Person.
Buyer Users (or their applicable Authorized Person) must pick up the order within 7 calendar days from the date on which Wristcheck’s purchase confirmation is sent to the Buyer User (such 7-calendar-day period, the “Pickup Window”). If the order is not picked up within the Pickup Window: any return request by Buyer after such expiration of the Pickup Window will be void and invalid; and
If the Buyer User fails to (or fails to authorize a person to) pick up the Product within 24 calendar months from the date the Product becomes available for pickup, Wristcheck may exercise its right (but shall have no obligation to) to sell the Product (including, but not limited to, selling in the open market or by way of tender) on the Buyer User’s behalf at any price. The proceeds of such re-sale shall be refunded to the Buyer User, subject to the deduction of any sums due to Wristcheck by the Buyer User and the reasonable costs incurred by Wristcheck in relation to the re-sale.
In the event Buyer purchases Products on the Platform and opts for delivery - For both shipping and in-store pickup method, Buyer Users will need to sign a confirmation of receipt of the order upon receipt or upon pick-up of the Products (as applicable). By signing such confirmation, the Buyer User:
- accepts the responsibility for the purchased Products (Wristcheck will not be held accountable for any damages subsequently identified), and the risk of the purchased Products shall be passed to the Buyer User; and
- agrees that the Return Period (as defined herein) for the order will commence forthwith.
- In the event Buyer (1) purchases Products on the Platform and opts for delivery or (2) purchases Products in-store - Upon purchase, Buyer Users accept the responsibility of the purchased Products and agree to No Return.
- If the receiver of the Products is an authorized person, Buyer Users accept that signature of such receiver is evidence of delivery and fulfilment of the order by Wristcheck.
- If (i) Buyer Users purchase Products on the Platform and opt for the shipping method, such purchase shall have a return period equal to 7 days, counted from the date on which the confirmation of receipt is signed by the Buyer User, Authorized Person or other authorized recipient; and (ii) Buyer Users opt for in-store pick up, such purchase shall have a return period equal to 7 days, counted from the date on which Wristcheck notifies the Buyer User of the successful purchase of a Product (in either case, such return window, the “Return Period”). Buyer Users may return the relevant Product prior to the expiration of such Return Period, provided that the Product is in its original packaging and, for Products delivered via the shipping option, in an unopened condition with the security seal intact. Final acceptance of any return and the decision to provide a partial or full refund to Buyer Users will be at Wristcheck’s sole discretion. For example, Wristcheck may, but is not required to, accept return of Products for which, in the reasonable view of Wristcheck, the condition of such Products has been misrepresented on the Platform. For the avoidance of doubt, Wristcheck will not accept a return of Product where Buyer Users (or the recipient of the Product) have a change of mind to not purchase the Product.
- In-store purchases or purchases for which the in-store pickup option is selected will not be eligible for returns in any case.
- Any Product returns or repairs are subject to the terms of the Wristcheck Warranty.
- Return or submission of any Products to Wristcheck by Buyer Users (whether subject to the Return Period or Wristcheck Warranty) are to be arranged by Buyer Users at their own costs and risks. Wristcheck is not responsible for (and Wristcheck’s insurance policy will not cover) any loss or damages incurred during transit.
- Buyer Users acknowledge and agree that it is each Buyer User’s sole responsibility to assess and comply with all applicable customs declarations and/or pay additional fees to the customs authority for any returned Product(s) and/or the materials incorporated in the returned Product(s). Wristcheck shall not be liable for any customs declarations and/or payments related to the Buyer User’s return(s), including, but not limited to, import duties, taxes, or any other fees imposed by the customs authority.
- Returns will only be valid if the Products are in the same condition such Products distributed at the time of sale. Such determination of condition is in Wristcheck’s sole discretion, and Wristcheck has the right to refuse returned Products whose condition it deems has declined. Returned Products will be inspected by Wristcheck’s Professional Services team. Buyer Users will incur a charge for any work necessary if the returned Products are found to be damaged or otherwise compromised.
- Buyer Users acknowledge that any paperwork included in the original shipment of Products (including, but not limited to, warranty cards and certificates, where supplied) (such original paperwork, the “Paperwork”) substantially increases the value of the Products and acknowledges that its absence or damage will negatively affect the value of the Products. If Buyer Users return any Products with missing or damaged Paperwork, Wristcheck will not accept the return, and the Product will be shipped back to the Buyer User at the Buyer Users’ own cost.
- Buyer Users must notify Wristcheck prior to initiating any Product return or other shipment of Product to Wristcheck, with such notification to occur by (i) notifying the Watch Specialist that assisted with their order via the method of communication used in prior interactions with such Watch Specialist; or (ii) emailing the Wristcheck Customer Care team at concierge@wristcheck.com. Such notification of return should include (i) the purpose of the shipment (such as return, repair under Wristcheck warranty, professional services) and (ii) confirmation of the Wristcheck delivery contact details.
- Return postage, packaging and insurance will be the responsibility of Buyer Users, and Buyer Users must follow the reasonable instructions of Wristcheck. Wristcheck recommends using a tracked mail system and recommends retaining proof of postage. Insurance must cover the full value of the Products. Buyer Users must ensure the Products are packaged appropriately to prevent damage during transit.
- Below are some suggestions on how to pack and send the Products to Wristcheck. If Buyer Users are based in Hong Kong, Buyer Users are encouraged to drop off their Products at Wristcheck boutique in The Landmark, Central, Hong Kong for security reasons.
- Disclaimer: Please note that these are only suggestions, and, as indicated herein, Wristcheck is not responsible for any damages, even if the below steps are followed.
- Avoid using branded packaging. A plain and sturdy cardboard box works best.
- Wrap the Product and all accessories safely and securely (e.g., with bubble wrap) to avoid scratches and damage during transit.
- Along with the Product, please safely and securely wrap (e.g., with bubble wrap) all of the Product’s accessories in the cardboard box – including original boxes for such accessories, Paperwork and any other parts that accompanied the Product upon purchase and original delivery.
- If the Product’s strap or any of its accessories contain exotic skins, such strap or accessories should be shipped in a package separate from the Product.
- Pack the bubble-wrapped items in a sturdy cardboard box and seal it carefully with packing tape.
- Arrange pickup or drop-off services from a trusted courier (such as DHL, FedEx, UPS, Malca-Amit or Ferrari Logistics) with a shipment tracking system.
- Be sure to inform concierge@wristcheck.com with the tracking number, Buyer User’s name and any other details that pertain to the Product once the shipment has been picked up by the courier.
- Nothing contained or implied herein shall constitute or be deemed to constitute a partnership or joint venture between the Parties.
- Except with the prior written consent of the other Party, neither Party shall be entitled to assign or transfer the benefit or burden of any provision herein. A person who is not a Party shall have no rights under the Contracts (Rights of Third Parties) Ordinance (Cap 623 of the laws of Hong Kong, as amended from time to time) to enforce any term contained herein.
- WRISTCHECK (INCLUDING ITS DIRECTORS AND EMPLOYEES) SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LOSSES, WHETHER SUCH DAMAGES ARE (OR ARE ALLEGED TO BE) AS A RESULT OF A BREACH OF CONTRACT, TORT OR OTHERWISE. ALL SUCH DAMAGES AND LOSSES ARE HEREBY EXPRESSLY WAIVED AND DISCLAIMED. WRISTCHECK DOES NOT GUARANTEE THE SUCCESSFUL PURCHASE OF PRODUCTS PURSUANT TO THESE BUYER TERMS AND CONDITIONS.
- THE BUYER USER AGREES THAT WRISTCHECK’S TOTAL AND AGGREGATE LIABILITY UNDER EACH PRODUCT PURCHASE HEREUNDER SHALL NOT EXCEED THE AMOUNT EQUIVALENT TO THE PURCHASE PRICE OF THE APPLICABLE PRODUCT.
- These Buyer Terms and Conditions may be updated by Wristcheck from time to time, and the latest effective version will be available on Wristcheck’s website. Any changes to these Buyer Terms and Conditions shall apply on the date specified in such email. By continuing to purchase Products from Wristcheck following any such notification of updates, the Buyer User acknowledges its acceptance of such updates.
- Any notice, demand or other communication so addressed to the Buyer User shall be deemed to have been delivered when sent (with confirmation that the same has been transmitted to the Buyer User’s registered email address with Wristcheck) and any notice, demand or other communication so addressed to Wristcheck shall be deemed to have been delivered when sent (with confirmation that the same has been transmitted to concierge@wristcheck.com). The Buyer User shall inform Wristcheck as soon as possible of any change to his/her email address registered with Wristcheck.
- If any provision in these Buyer Terms and Conditions is for any reason held invalid or unenforceable in any respect, such invalidity or unenforceability shall not affect any other provision of these Buyer Terms and Conditions, but, rather, such invalid or unenforceable provision shall be enforced to the fullest extent permitted by law.
- These Buyer Terms and Conditions shall be governed by the laws of New York. The Parties hereby agree to submit to the non-exclusive jurisdiction of the courts of New York. Any dispute, controversy, or claim arising out of or relating to Products hereunder or the breach or termination hereof shall be settled by binding arbitration conducted by JAMS (“JAMS”) in accordance with JAMS Comprehensive Arbitration Rules and Procedures (the “Rules”). The arbitration shall be heard by one arbitrator to be selected in accordance with the Rules. The arbitration shall take place in New York, New York, USA. Judgment upon any award rendered may be entered in any court having jurisdiction thereof. Within seven (7) days after appointment, the arbitrator shall set the hearing date, which shall be within ninety (90) days after the filing date of the demand for arbitration unless a later date is required for good cause shown. In addition to all other relief, the arbitrator shall have the power to award reasonable attorneys’ fees and costs to the prevailing party. Notwithstanding the foregoing, the Parties expressly agree that the agreement to arbitrate in this Section shall not limit Buyer’s ability to seek and receive emergency injunctive relief from a court of competent jurisdiction.
