United States Privacy Policy

This United States Wristcheck Privacy Policy (“U.S. Privacy Policy”) describes how Wristcheck Americas, Inc. (“Wristcheck”) processes and uses the personal information about U.S. residents (“you”) that Wristcheck collects through its websites (e.g., “https://.wristcheck.com”), mobile apps downloaded through U.S. app stores, and other U.S.-based services provided to you (collectively, the “Services”).
Wristcheck may update this U.S. Privacy Policy from time to time, and the updated U.S. Privacy Policy applies to you after the effective date stated in the revised U.S. Privacy Policy. Please come back to this page occasionally to check to see if it has been updated. If Wristcheck’s information practices regarding your personal information change, Wristcheck will post the updated U.S. Privacy Policy on its websites and mobile apps. If Wristcheck changes this U.S. Privacy Policy in a material way, Wristcheck will provide appropriate notice to you such as posting a prominent notice on its websites or mobile apps or emailing you if you provided your email to Wristcheck.
Wristcheck collects personal information in three ways: (i) Wristcheck collects personal information you provide; (ii) Wristcheck collects personal information automatically through operating the Services; and (iii) Wristcheck collects personal information from others as further described below.
- Personal information you provide: Wristcheck collects personal information that you provide. The type of information Wristcheck collects depends on the context and how Wristcheck uses the personal information. Examples of personal information Wristcheck collects from you include the following:
- Account information: You may provide certain information to Wristcheck to set up your account with Wristcheck. For example, Wristcheck may collect your first name, last name, email address, password, and, if applicable, personal information associated with third-party social media accounts that you use to create or sign into an account (e.g., your profile picture, birthday, friends and followers, etc.). Depending on your account sign-in method, Wristcheck may also collect your biometrics for facial recognition or fingerprint identification.
- Transaction information: You may provide certain transaction and other commercial information to Wristcheck to receive the Services. For example, Wristcheck may collect your credit card information, bank account information, and transaction history.
- Communication: You may also provide Wristcheck with personal information when you submit questions or feedback or otherwise communicate with Wristcheck.
- Personal information automatically collected: Wristcheck also collects personal information automatically collected from your devices. Examples of personal information Wristcheck automatically collects include the following:
- Log information: Like many businesses, Wristcheck may collect information that web browsers, mobile devices, and servers typically make available, such as the browser type, Internet Protocol address, unique device identifiers, language preference, referring site, the date and time of access, operating system, and mobile network information
- Location information: If you allow Wristcheck’s access to your location data, Wristcheck will collect the location information, including precise geolocations (e.g. GPS-based functionality on mobile devices used to access the Services).
- Tracking technologies: Wristcheck may use cookies and other technologies like pixel tags to help identify and track users, usage, and access preferences for the Services, as well as track and understand campaign effectiveness and to deliver personalized ads. - Personal information collected from others: Wristcheck also collects personal information from other third parties. Examples of personal information Wristcheck collects from third parties include the following:
- Linked sites: Wristcheck may collect certain personal information from third-party websites, such as social media platforms (collectively, the “Linked Sites”). For example, when you engage with Wristcheck accounts through Linked Sites such as third-party social media sites, you may be allowing Wristcheck to access certain information stored on those Linked Sites as described to you by those Linked Sites (e.g., your public profile, profile photo, friends list, etc.) in accordance with their privacy policies.
- Others: Wristcheck may also obtain your personal information when others, like other Wristcheck users, provides your personal information to Wristcheck as part of their interaction with Wristcheck.
Wristcheck uses your personal information as mentioned above and for the purposes listed below:
- To provide and improve the Services, including to provide you with access to the Services; to operate, improve, and optimize the Services; to conduct research and development; and for business analytics.
- To communicate with you, including to handle your requests or complaints; to conduct surveys and solicit customer reviews; to send newsletters or transactional, marketing, or promotional messages and other information.
- To personalize or enhance your experience, including to offer tailored content that may interest you.
- For fraud detection, security, and other business and operational purposes, including to enforce Wristcheck’s legal and/or contractual obligations and rights; to resolve disputes; for Wristcheck’s internal business and administrative purposes; and for compliance with relevant laws and regulations.
Wristcheck discloses personal information for the purposes described above to the following categories of entities:
- Affiliates, employees, and contractors: Wristcheck may disclose your personal information to its affiliates, employees, and independent contractors or representatives that need to know your personal information.
- Service providers and business partners: Wristcheck may disclose your personal information to service providers and business partners that help Wristcheck operates its business, such as data storage service providers, mailing service providers, analytics and advertising partners, and security service providers.
- Parties to corporate transactions: Wristcheck may disclose your personal information in connection with any merger, sale of company assets, or acquisition of all or a portion of Wristcheck’s business by another company.
- Other entities: Wristcheck may also disclose your personal information with other entities, including as may be necessary to detect security incidents and fraudulent or illegal actions or to protect the safety, property, or other rights of any person or entity; to comply with law, a court order, or other legal process; in connection with a legal investigation; to enforce any applicable terms and conditions and other agreements; as otherwise may be required or permitted by applicable law; or in accordance with your consent or direction.
Wristcheck retains your personal information for the length of time needed to carry out the processing purposes described in this U.S. Privacy Policy, consistent with Wristcheck’s retention policy and as permitted by applicable law.
Wristcheck seeks to keep your personal information secure by implementing reasonable technical, administrative, and physical safeguards to help protect such information from unauthorized access, use, and disclosure. However, please be aware that no method of electronically transmitting or storing information is ever completely secure.
- Children and Minors: The Services are not intended for use by children and minors under 18 years of age. If Wristcheck learns that it has collected personal information through the Services from a child or a minor under 18, it will promptly delete it.
- Do Not Track: Some web browsers may have a “Do Not Track” setting that transmits a “Do Not Track” header to the websites you visit with information indicating that you do not want your activity to be tracked. Wristcheck does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed.
- Shine the Light: For the purpose of California’s “Shine the Light” law as codified in California Civil Code Section 1798.83-84, as of the effective date of this U.S. Privacy Policy, Wristcheck does not share California residents’ personal information with third parties for such third parties’ own direct marketing purposes.
